Support Heroes, Reap Returns: The 3M Firefighter Foam Case (Part 9)
In our journey of exploring the landmark late-stage litigation cases we are targeting in the Diversified Litigation Portfolio, we now turn to the 3M AFFF Firefighter Foam litigation.
This case not only stands out for its profound impact on public health but also exemplifies our strategy of selecting high-potential, late-stage litigation cases that align with our goal to deliver consistent and high returns for our investors.
Background on AFFF and PFAS:
For decades, 3M’s aqueous film forming foam (AFFF) has been widely used by both military and civilian firefighters. The problem? It contains per- and polyfluoroalkyl substances (PFAS), or “forever chemicals,” that have been used since the 1950s due to their resistance to water, oil, and heat.
Scientific studies have linked PFAS to a range of severe health problems, including cancer, immune system effects, and thyroid hormone disruption. Non-Hodgkin’s lymphoma, in particular, has devastated the lives of many affected firefighters. Yet 3M continued to sell these products, despite knowing that firefighters were at risk from exposure to the chemicals.
Proposed Legislation and Low-Risk Investment:
Proposed legislation currently in Congress includes $1 million in compensation for each firefighter affected by PFAS exposure.
While it’s not necessary for this legislation to pass for our litigation to succeed, if it does, it will provide a separate avenue for us to seek compensation and returns alongside the 3M Mass Tort.
The mere existence of this proposed legislation further helps to solidify the causality and liability, making settlements likely to happen faster and with greater value.
Legal Proceedings and Quick Settlements: Confirmation of Misconduct and Causality
3M has faced allegations of not disclosing the potential health risks associated with PFAS exposure and related contamination of drinking water — and they’ve been eager to settle these cases, reflecting the strength and validity of the claims. Recent settlements have reached billions of dollars, underscoring the company’s acknowledgment of their liability and causality of the harm.
Our Heroes:
For decades, 3M continued to sell these products despite knowing the potential health risks. These civilian and military firefighters, the heroes who protect our communities and nation, have been exposed to these harmful chemicals, leading to severe health issues. Non-Hodgkin’s lymphoma, in particular, has devastated the lives of many affected firefighters.
